Terms of Sale
These terms apply to every TENSA mixer and accessory sold by Evgenii Goriaev, a self-employed sole trader (autónomo) registered in Spain, trading as TENSA (details in the Legal Notice). If you buy as a consumer, nothing here limits the rights that the law of Spain or of your country of residence gives you.
1. How an order works
Every TENSA is assembled by hand, one by one, in Valencia.
- Request. The preorder form on tensa.cc is a request, not a purchase. It is free and does not commit you to anything.
- Proforma. We confirm your configuration, delivery address and customer type (private person or company) by email and send you a proforma invoice with the price, the estimated shipping month and these terms.
- Contract. The contract is concluded when we receive your payment and confirm it by email. From that moment your unit has its place in the build queue.
- Build queue. Units are built in the order payments arrive. We keep you updated on the status of your unit.
2. Prices and taxes
- Prices are in euros. The proforma states the price of your configuration, the tax applied and, at the end, the shipping cost.
- Private customers in the EU pay VAT: currently Spanish VAT (21%). If we register under the EU One-Stop Shop (OSS), the VAT rate of your country applies instead; your proforma always states the exact amount.
- Companies in the EU with a VAT number valid in VIES are invoiced without VAT (reverse charge).
- Customers outside the EU are invoiced without Spanish VAT (export). Import duties, taxes and customs fees in your country are paid by you on delivery (see Shipping).
- The price confirmed in your proforma does not change after you have paid.
3. Payment
- Full payment in advance. The price of your TENSA is paid in full against the proforma, within 7 days. If the payment does not arrive, the proforma expires and the place goes to the next customer.
- Shipping is invoiced separately when your unit is assembled and tested, together with photos or a video of your own unit. We ship once the shipping invoice is paid.
- Methods: bank transfer (SEPA within the EU, SWIFT elsewhere). Bank charges on the sender's side are paid by the sender.
- The unit remains our property until it has been paid in full.
4. Lead time and delays
- The proforma gives an estimated shipping month. Lead time is currently about 2–3 months from payment.
- Some parts are made for us to order (for example, the toroidal transformers are wound and potted for TENSA), so dates can move. If the estimate changes, we tell you straight away and give you a new date.
- If your unit has not shipped within 8 weeks after the estimated month, you may cancel and get every payment back in full.
5. Changes and cancellation before shipping
- You can change your configuration free of charge until we start building your unit. After that, ask us. We will say whether the change is still possible and whether it changes the price or the date.
- You can cancel your order at any time before shipping and get your payment back in full within 14 days. Just email us.
- Bespoke work beyond the options in our configurator (for example, an engraving or a material we source only for you) is agreed separately in writing, and the proforma will say whether it can be refunded.
6. Delivery
We ship insured, with tracking and a signature on delivery. For a private customer, the risk passes when the unit is handed to you or to someone you named. For a company, it passes when the unit is handed to the carrier. Details are in Shipping.
7. Returns and right of withdrawal
Private customers can withdraw from the purchase within 14 days of receiving the unit, as described in Returns & Right of Withdrawal. Companies do not have this right; for them the warranty applies.
8. Warranty
Every TENSA has a 3-year warranty, and we keep servicing it afterwards. See Warranty & Service.
9. Safety
The power supply produces up to 350 V DC for the tubes. Do not open it, and do not connect or disconnect the cable between the power supply and the mixer while the power supply is switched on. Use only the supplied power supply and cable, at the mains voltage selected for your unit.
10. Liability
We are liable without limitation for death or personal injury, for intent and gross negligence, and wherever mandatory law (including product liability law) says so. In all other cases our liability is limited to the price of the unit and to damage that was foreseeable when the contract was made. We are not liable for indirect damage such as lost earnings or cancelled gigs, unless mandatory law says otherwise.
11. Personal data
We use your details only to handle your order and your warranty. See the Privacy Policy.
12. Law and disputes
- These terms are governed by Spanish law. If you are a consumer living in another country, you keep the protection of the mandatory laws of that country.
- If something goes wrong, write to us first: [email protected]. We answer every message personally.
- A consumer may bring a claim before the courts of their place of residence. We do not take part in consumer arbitration proceedings (Sistema Arbitral de Consumo).
- For companies, the courts of Valencia (Spain) have jurisdiction. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
13. Changes to these terms
The version of these terms that applies to your order is the one in force on the day you paid. It is the version linked from your proforma.
